OFFICIAL RULES AND REGULATIONS (“Giveaway Rules”)

November 1, 2023 to November 24, 2023.

WESTMAN COMMUNICATIONS GROUP (WCG) – MEM-VEMBER GIVEAWAY (THE “GIVEAWAY”) IS INTENDED FOR RESIDENTS OF MANITOBA ONLY AND IS GOVERNED BY CANADIAN LAW AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE (i) AN ACTIVE MEMBER OF WESTMAN FOR FIVE (5) YEARS OR MORE WITH GOOD ACCOUNT STANDING. FOR THE PURPOSE OF THIS GIVEAWAY, GOOD ACCOUNT STANDING MEANS THE WINNER MUST NOT BE DELINQUENTLY INDEBTED TO WESTMAN OR ANY OF ITS AFFILIATES WITHIN THE PAST 5 YEARS AT THE TIME OF THE DRAW.(ii) OF THE AGE OF MAJORITY, OR OLDER AT THE TIME OF ENTRY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THIS GIVEAWAY CONSTITUTES ACCEPTANCE OF THESE GIVEAWAY RULES (THE “GIVEAWAY RULES”).

1. HOW TO ENTER:

i.       All active Westman members of five (5) consecutive years or more with good account standing - for at least 5 years at the time of the draw- are automatically entered in the draw with one (1) entry.

 This contest is sponsored by Westman Communications Group (“Westman”). NO PURCHASE NECESSARY.
 

2. GIVEAWAY PERIOD:

The giveaway period will begin at 9:00 a.m. Central Standard Time (“CST”) on Wednesday, November 1, 2023 and will end at 11:59 p.m. CST on Friday, November 24, 2023 (the “Giveaway Period”) after which time the giveaway will be closed and no further entries shall be accepted.

3. ELIGIBILITY:

To enter and be eligible to win, the entrant must be:

i.  An active member of Westman for five (5) years or more and resides in Manitoba;

ii. The entrant should have good account standing which means he or she should not be delinquently indebted to Westman or any of its affiliates within the past 5 years, at the time of the close of the draw.

iii.  of the age of majority in Manitoba or older at the time of entry; and

Employees, officers and directors of Westman and its partners and associate companies, their advertising and promotional agencies and their respective affiliates and associates, and such individual’s immediate family members and persons with whom such individuals are domiciled, are not eligible to enter or participate in this giveaway. For these official rules, “immediate family” refers to the father, mother, brothers, sisters, children, husband, wife or partner of such an employee, agent and/or representative. A winner of a Westman contest or giveaway within three (3) months preceding November 1, 2023 (including persons designated by such winners to take ownership of the prize) and persons domiciled with such a winner are not eligible to enter.

All entries become the sole property of Westman and none will be returned for any reason. Westman shall have the right at any time to require proof of identity and/or eligibility to participate in the giveaway. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Westman for the purpose of the giveaway must be truthful, complete, accurate and in no way misleading. Westman reserves the right, in its sole discretion; to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

4.  ENTRY:

One (1) entry is allotted to each loyal member of 5 years or more. In the event of a dispute, entries shall be deemed to be submitted on behalf of the “Authorized Account Holder” of the account. “Authorized Account Holder” is defined as the natural person whose name is assigned to a Westman account, that is, his/her name is the main name of the account. If it is discovered that you attempted to enter more than once, all entries will be void.

5. PRIZE: 

i.       There is two (2) prizes available to be awarded - The grand prize of one (1) year of Digital HD TV services from Westman Communications Group, one (1) Connor Bedard Hockey Canada Jersey, and one (1) Lenovo Laptop, and a secondary prize of two (2) tickets to Cirque Du Soleil.

ii.      The prizes have an approximate value of three thousand Canadian Dollars ($3,000.00 CDN), and three hundred and fifty Canadian Dollars ($350.00 CDN).

iii. Depending on the current package the member may subscribe to, the total prize value for the grand prize may not cover the total subscription costs for the full calendar year.

iv.  Winner is not entitled to monetary difference between the actual prize value and stated approximate prize value, if any.

v.    A Westman representative(s) will contact the winner to coordinate prize arrangements within two (2) business days of prize draw. The winner has up seven (7) days after being contacted and notified of his/her prize to fulfill the requirements set out herein.

vi.      The prize is not redeemable in cash and is not transferable. The prize must be accepted as awarded — no substitutions at the request of winning entrant will be made, except at the sole discretion of Westman.

vii.  Westman reserves the right, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of the prize or component of the prize for any reason whatsoever.

viii. Additional expenses on top of the awarded prizes are the responsibility of the winning member.

ix. Shipping or delivery of the prize is the responsibility of the winning member.

x.    Westman shall not assume any liability for lost, damaged or misdirected prizes.

6. GENERAL: 

i.       Two (2) random draws will take place and be announced on social media on November 24, 2023. 

ii.      The odds of winning the prize will depend upon the total number of eligible entries during the giveaway period.

iii.     Westman, acting reasonably, will attempt to contact the potential winner via email or phone call within two (2) business days after the draw. In the event that the potential prize winner cannot be contacted within two (2) business days after the draw, or is contacted but does not accept the prize within seven (7) days after the draw, he or she will be disqualified and Westman reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries. Upon notification, the selected entrant must respond by phone or email to the contact number or email address provided in the notification, and the selected entrant’s response must be received by Westman within three (3) business days of such notification. If the selected entrant does not respond in accordance with the giveaway rules, he/she will be disqualified and will not receive a prize and another entrant may be selected in Westman’s sole discretion until such time as an entrant satisfies the terms set out herein. Westman is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for Westman to receive a selected entrant’s response. Proof of identification must be provided upon request.

iv.    Decisions of the contest judges (Westman) are final — no substitutions will be available.

v.      Before being awarded the prize, the potential winner will be required to sign a full release and indemnity form (the “Release”) as prepared by Westman, acknowledging and confirming:

                 i.     he/she has read and understands these Official Rules and Regulations (“Giveaway Rules”);

                 ii.     eligibility for the giveaway and compliance with these giveaway rules;

                iii.     he/she grants all consents required;

                iv.     acceptance of the prize, as awarded;

                v.     he/she releases Westman, and each of their parent companies, subsidiaries, affiliates, partners, associates and/or related companies and agents and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the giveaway, participation in any contest-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from;

               vi.     authorizes Westman to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, pseudonym and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential prize winner beyond the awarding of or participation in the prize to the extent permitted by law.

In the event the release is not signed and returned within the time stipulated by Westman, the winner will be deemed to have forfeited his/her prize. Westman reserves the right, at its sole discretion, to select another winner.

vi.    Once Westman receives the release, Westman will award the prize.

vii.   By entering the giveaway, entrant releases and holds the Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the giveaway, any breach of the giveaway rules, or in any prize-related activity. The entrant agrees to fully indemnify the releasees from any and all claims by third parties relating to the giveaway, without limitation.

viii.  In the event potential winner does not comply with all the provisions as contemplated in these giveaway rules, Westman shall have the right to disqualify winner and draw an alternate winner. Westman shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until a qualified prize winner has been duly selected.

ix.    Westman assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Westman is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the giveaway or by any technical or human error which may occur in the administration of the giveaway. Westman assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Westman is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise. Westman is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this giveaway. Entrant assumes liability for injuries caused or claimed to be caused by participating in the giveaway, or by the acceptance, possession, use of, or failure to receive any prize. Westman assumes no responsibility or liability in the event that the giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors (if any), such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this contest, and/or the contest website. Westman assumes no responsibility for entries which fail to comply with these contest rules or for any failure of Westman’s web site during the giveaway period, including any problems or technical malfunctions of any computer on-line systems, servers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereon.

x.      All entries are subject to verification. Since each qualified member is automatically entered, by not indicating you  want out or by not calling or emailing to opt out of this giveaway, each entrant agrees to be bound by the giveaway rules. Entrants further agree to be bound by the decisions of Westman, which shall be final and binding in all respects. Westman reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the giveaway rules; (b) tampering or attempting to tamper with the entry process or the operation of the giveaway, or any related promotional website; (c) using any automated script, macro, robotic or other program(s) to enter or otherwise participate in this giveaway; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, WESTMAN RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

xi.    In the event of any discrepancy or inconsistency between the terms and conditions of the giveaway rules and disclosures or other statements contained in any giveaway related materials, including but not limited print or online advertising, the terms and conditions of the giveaway rules shall prevail, govern and control.

xii.   Westman reserves the right, in its sole discretion, to terminate the giveaway, in whole or in part, and/or modify, amend or suspend the giveaway, and/or the giveaway rules in any way, at any time, for any reason without prior notice.

xiii.  All intellectual property, including but not limited to, trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations used in connection with the giveaway are the property of Westman and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

xiv. By entering the giveaway, the entrant understands and agrees that Westman will collect, use and disclose her/his personal information only in relation to this giveaway. Westman’s privacy policy is available at westmancom.com/privacy-policy-ccts/. Any questions regarding Westman’s privacy policy or the treatment of your personal information should be directed to the Westman Privacy Officer. Personal information collected for Westman will be used in accordance with the Westman program rules and Westman’s Privacy Policy. No additional personal information is collected for this giveaway

xv.   This contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Westman. All issues and questions concerning the construction, validity, interpretation and enforceability of the contest Rules or the rights and obligations as between the entrant and Westman in connection with the contest shall be governed by and construed in accordance with the laws of the province of Manitoba including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

xvi. All inquiries regarding the giveaway should be directed to Westman.
